Terms of Use
These Terms govern your use of GhostStride's applications, website and related services ("Services"). By using the Services, you agree to these Terms.
1. Fitness and safety
GhostStride is a fitness/recreational running tool, not a medical device or medical service. Pace, distance, calories, heart rate, GPS position and other measurements may be delayed, estimated, incomplete or inaccurate. Do not rely on GhostStride for medical decisions, emergencies, navigation or personal safety.
You are responsible for deciding whether you can exercise safely, choosing safe routes and surroundings, observing traffic and local rules, and stopping when appropriate. Seek qualified medical advice where appropriate.
2. Accounts
You are responsible for your account and authentication access. You must not impersonate others, violate their rights or use the Services abusively.
3. Friends, Community and Run Together
Community search helps users locate accounts by name and username. You decide whom to add/accept. Friend-only features may expose additional information to accepted friends. During Run Together, information needed for the live experience, including location-derived progress and/or location, may be transmitted to the participating accepted friend.
4. User content
You retain your rights in submitted content such as profile pictures and grant us a limited non-exclusive license to host, process, transmit and display it as reasonably necessary to provide the Services. You must have the necessary rights to upload it.
5. Acceptable use
Do not attempt unauthorized access, interfere with security/operation, unlawfully harvest user information, harass users, upload unlawful/infringing material, commit fraud or violate applicable law.
6. Availability
Features, compatibility and availability may change. We do not guarantee uninterrupted or error-free operation, synchronization, GPS, notifications, friend features or third-party services.
7. Third parties
The Services may depend on Apple and Google/Firebase services, governed by their own terms and policies.
8. Intellectual property
GhostStride software, branding, interface, graphics and supplied materials are protected by applicable intellectual-property laws.
9. Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Nothing excludes rights or warranties that cannot legally be excluded.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GHOSTSTRIDE AND ITS OWNERS, OPERATORS, AFFILIATES, PERSONNEL AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, REVENUE, GOODWILL OR BUSINESS OPPORTUNITY ARISING FROM THE SERVICES.
We do not assume responsibility for injuries, accidents, unsafe routes/surroundings, third-party conduct, inaccurate GPS/fitness measurements, failed synchronization, device/network failures, or decisions based on displayed information, except where liability cannot legally be excluded or limited.
11. Indemnity
To the extent permitted by law, you agree to indemnify GhostStride and its operators against claims and reasonable costs arising from unlawful misuse, your content, or violations of these Terms or another person's rights.
12. Consumer rights
Nothing limits mandatory consumer rights that cannot be waived, including applicable EU/EEA/UK protections.
13. Termination
You may stop using the Services at any time. We may restrict access where reasonably necessary for security, law, serious/repeated violations, or protection of users/Services, subject to applicable law.
14. Governing law
These Terms remain subject to mandatory applicable law. The operator's governing-law/forum provision should be completed based on its actual legal entity and jurisdiction before launch.
15. Changes
We may update these Terms as the Services or legal requirements change, with notice where required.
